Terms of Service

1. Acceptance of Terms

By creating an account or using Hunting Passport ("we," "us," the "Service"), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service. You must be at least 18. The contracting entity is identified in the Governing Law section.

2. The Service

Hunting Passport is a digital journal and social platform for documenting hunting expeditions, harvested animals, equipment, statistics, and optional connections between members. It is a record-keeping and social tool only; it does not provide hunting, legal, safety, navigational, or veterinary advice, is not a legal survey, and must not be relied on where precise location, boundaries, or field conditions matter.

3. Eligibility & Account Security

You must be at least 18 and able to enter this agreement. You are responsible for all activity under your account, for keeping your password confidential, and for notifying us of any unauthorized use. Provide accurate information and keep it updated. We may suspend or terminate accounts that violate these Terms or provide false information.

4. Compliance with Hunting Laws

You are solely responsible for complying with all laws, licenses, permits, tags, seasons, bag limits, and firearm regulations in every jurisdiction where you hunt or travel. We do not verify or endorse the legality of anything you record; logging an activity is not evidence of its legality. You assume all risk of hunting and outdoor activity.

5. Your Content & License

You retain ownership of everything you log ("Your Content"). You grant us a limited, worldwide, non-exclusive, royalty-free license to host, store, process, and display Your Content solely to operate the Service for you and, where you choose, for members you allow. This license ends when you delete the content or your account, except for content others already lawfully viewed and limited backups. We do not sell Your Content and do not use it to train third-party AI models.

6. Acceptable Use

You agree not to: violate any law or third-party right; upload unlawful, infringing, harassing, or harmful content; impersonate others or misrepresent affiliation; attempt unauthorized access; interfere with or overload the Service; or use it to build a competing product.

7. Automated Access & Member Protection

You may not use any robot, spider, scraper, crawler, deep-link, page-scrape, or other automated or manual process to access, copy, monitor, or harvest any part of the Service or other members' information, nor bypass its navigation, structure, or security. You may not reverse look-up, trace, or attempt to identify any member, or probe or test the Service's security. We reserve the right to prohibit and pursue any such activity.

8. Privacy & Locations

Your hunt locations and exact coordinates are private by default and are never shown on the public web or to search engines. What signed-in members can see depends on your privacy setting (Public or Private) and your follow relationships, per the Privacy Policy. Your real name and exact locations are never displayed publicly.

9. Subscriptions & Payments

The Service offers a free tier and a paid "Pro" subscription; features, pricing, and billing cycles are shown at purchase. Payments are handled by third-party providers; we do not store full card details. Subscriptions renew automatically unless canceled before renewal. You may cancel anytime in Settings, effective at the end of the current period. Except where required by law, paid fees are non-refundable and not prorated. Pricing may change on a going-forward basis with notice.

10. AI & Automated Features

Any output from AI or automated features is for general informational purposes only, may be inaccurate or incomplete, and is not professional advice or a binding commitment. Do not rely on it where accuracy is critical; always verify independently.

11. Third-Party Services

The Service relies on third parties (hosting, database, maps, payments) and may link to third-party sites, which are governed by their own terms; we are not responsible for them.

12. Termination

You may stop using the Service and delete your account anytime. We may suspend or terminate access if you violate these Terms or to protect the Service or members. Sections that by nature should survive (ownership, disclaimers, liability limits, indemnity, dispute resolution) survive termination.

13. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant the Service will be uninterrupted, secure, error-free, or that any content or statistics will be accurate or complete.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR OWNERS, OFFICERS, AND PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS (USD $100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless the Company, its owners, and providers from any claim, loss, liability, or expense (including reasonable legal fees) arising from your use of the Service, Your Content, or your violation of these Terms or any law or third-party right.

16. Dispute Resolution

We will first try to resolve any dispute informally; you agree to contact us and allow a good-faith period of at least thirty (30) days before formal proceedings. For users in the United States: any unresolved dispute will be resolved by binding individual arbitration, not in court, except that either party may bring an individual claim in small claims court or seek injunctive relief to protect intellectual property. YOU AND THE COMPANY WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. Any claim must be brought within one (1) year after it arises or be permanently barred, except where law prohibits such a limit. The prevailing party may recover reasonable attorneys' fees and costs to the extent permitted by law. For users in Mexico, disputes are subject to the applicable consumer-protection (PROFECO) and data-protection authorities and the competent courts in the Governing Law section.

17. Geographic Availability

The Service is operated from the jurisdictions where its operating entities are established. It may be accessed from many locations, but we make no representation it is appropriate or available everywhere, and features may vary by region. Accessing from outside those jurisdictions is on your own initiative and subject to local law.

18. Governing Law & Contracting Entity

Hunting Passport may initially be operated by an entity in Mexico and later by an affiliated U.S. entity, or both. For users resident in Mexico, these Terms are governed by Mexican law and applicable disputes are subject to the competent courts of Mexico City, without prejudice to mandatory consumer protections (PROFECO) and the LFPDPPP. For users in the United States and elsewhere, these Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules, subject to the arbitration section.

19. Changes & Contact

We may update these Terms; we will post a new "Last updated" date and, for material changes, give reasonable notice. Continued use after changes constitutes acceptance. Questions: legal@huntingpassport.com.
